• Upsider market opportunity scanner (premium feature)
• Email notifications for market opportunities (optional)

3. Disclaimer of Financial Advice

You acknowledge and agree that:

• Comic values fluctuate and actual sale prices may differ significantly from estimates
• Grading results from CGC, CBCS, or other services may differ from your estimated grade
• All buying, selling, and grading decisions are made at your own risk
• You should conduct your own research before making any financial decisions
• Past pricing data does not guarantee future values

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMICVALUATOR AND ITS OWNERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any financial losses resulting from decisions made based on our estimates or recommendations
• Inaccurate valuations or pricing data
• Differences between estimated grades and actual grading results
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or other intangible losses

You expressly understand and agree that your use of the service is at your sole risk.

5. Indemnification

You agree to indemnify, defend, and hold harmless ComicValuator and its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service or violation of these terms.

6. Accuracy of Information

While we strive to provide accurate pricing data and analysis, we make no warranties or guarantees regarding:

• The accuracy, completeness, or timeliness of pricing data
• The reliability of third-party data sources
• The accuracy of grading cost estimates
• The suitability of recommendations for your specific situation

7. User Accounts

If you create an account, you are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Providing accurate account information

8. Subscription Plans and Payments

ComicValuator offers both free and paid subscription tiers:

8.1 Free Tier

The free tier provides basic access to the service with limited collection storage.

8.2 Paid Subscriptions

Paid subscription plans provide enhanced features and increased collection limits. By subscribing:

• You authorize us to charge your payment method on a recurring monthly basis
• Subscription fees are billed in advance each billing cycle
• All fees are non-refundable except as required by law
• Prices may change with 30 days notice to subscribers

8.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• No partial refunds are provided for unused portions of a billing period
• Your account will revert to the free tier after cancellation
• Collection items exceeding free tier limits will be preserved but marked as inactive

8.4 Payment Processing

Payment processing is handled by Stripe, Inc. By making a purchase, you also agree to Stripe's terms of service. We do not store your full payment card details on our servers.

8.5 Failed Payments

If a payment fails, we will attempt to process the payment again. After multiple failed attempts, your subscription may be suspended or downgraded to the free tier.

9. Intellectual Property

ComicValuator and its original content, features, and functionality are owned by ComicValuator and are protected by copyright, trademark, and other intellectual property laws. Comic titles, characters, and related properties are trademarks of their respective owners.

10. Third-Party Services

Our service integrates with third-party services including:

• Grand Comics Database (GCD): Comic metadata and cover images (CC BY 3.0 license)
• PriceCharting: Real-time market pricing data for comic valuations
• Comic Vine: Creator credits, character data, and fallback cover images
• Metron: Fallback cover images (CC BY-SA 4.0 license)
• GoCollect: Market insights for grading opportunities
• Stripe: Payment processing for subscriptions

We are not responsible for the accuracy of third-party data or the availability of third-party services. Comic metadata is sourced from the Grand Comics Database and is used under the Creative Commons Attribution 3.0 license. Cover images are sourced from GCD, Comic Vine, and Metron and are subject to their respective terms of use.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

12. Changes to Terms

We may revise these Terms of Use at any time. By continuing to use the service after changes are posted, you accept the revised terms.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
